This End User License Agreement ("Agreement") is a legal agreement between you ("you" or "User") and O Street ("O Street," "we," "our," or "us") governing your use of the Wittle mobile application ("Wittle" or the "App").
By downloading, installing, accessing, or using Wittle, you agree to be bound by this Agreement. If you do not agree to these terms, do not use the App.
1. License Grant
Subject to your compliance with this Agreement, O Street grants you a limited, personal, non-exclusive, non-transferable, revocable license to install and use Wittle on devices that you own or control in accordance with the terms of this Agreement and the terms of the applicable app store.
This license is granted solely for your personal, non-commercial use.
2. Ownership
Wittle is licensed, not sold.
The App, including its software, artwork, graphics, text, sounds, trademarks, logos, gameplay systems, and all related intellectual property, is owned by O Street or its licensors and is protected by applicable intellectual property laws.
Except for the limited license granted in this Agreement, no ownership rights are transferred to you.
3. Eligibility
Wittle is intended for users who are at least 13 years of age or the minimum age required by applicable law in their jurisdiction.
If you are under the age of majority where you live, you represent that you have permission from a parent or legal guardian to use the App.
4. Accounts
Certain features require an account.
You may initially use Wittle with an anonymous account and later choose to link your account using supported authentication methods.
You are responsible for maintaining the security of your account and for activities occurring under your account.
5. Acceptable Use
You agree that you will not:
- Cheat, exploit bugs, or use unauthorized modifications.
- Reverse engineer, decompile, or attempt to extract the source code except where permitted by law.
- Use bots, scripts, automation, or other unauthorized software.
- Harass, threaten, impersonate, or abuse other users.
- Use offensive, unlawful, or misleading display names.
- Attempt to interfere with the operation, security, or availability of Wittle.
- Use the App for any unlawful purpose.
O Street may investigate suspected violations and may suspend or terminate accounts that violate this Agreement.
6. Multiplayer Conduct
Wittle includes multiplayer features.
You are responsible for your conduct and for any information you choose to make visible to other players, including your display name.
We reserve the right to moderate user-generated content, investigate reports of misconduct, and remove or restrict access to accounts that violate this Agreement.
7. Virtual Currency
Wittle includes virtual in-game currency known as Leaves.
Leaves:
- are licensed, not owned;
- have no cash value;
- cannot be redeemed for money or anything of monetary value;
- may not be transferred, sold, or exchanged except where expressly permitted by O Street.
O Street may modify, replace, discontinue, or rebalance virtual currency or virtual items as reasonably necessary to maintain the operation of the App.
8. Purchases and Subscriptions
Wittle offers optional in-app purchases and optional auto-renewing subscriptions.
Current pricing and available purchase options are displayed through the Apple App Store or Google Play Store and may change over time.
Subscriptions automatically renew unless cancelled through your Apple App Store or Google Play account before the renewal date.
Billing, cancellations, refunds, and payment processing are handled by the applicable app store and are subject to that platform's terms and policies.
9. Advertising
The free version of Wittle may display advertisements.
Users with an active eligible subscription receive an ad-free gameplay experience while their subscription remains active.
10. Updates
O Street may release updates, patches, bug fixes, balance changes, and new features.
Some updates may be required in order to continue using certain features of the App.
11. Availability
We strive to keep Wittle available and functioning properly, but we do not guarantee uninterrupted availability.
Features may occasionally be unavailable because of maintenance, technical issues, third-party service interruptions, or circumstances beyond our reasonable control.
12. Privacy
Your use of Wittle is also governed by our Privacy Policy, which explains how we collect, use, and protect your information.
13. Termination
You may stop using Wittle at any time.
O Street may suspend or terminate your access if you violate this Agreement, engage in abusive behavior, attempt to compromise the integrity of the App, or otherwise misuse the service.
Upon termination, the license granted under this Agreement immediately ends.
Sections intended by their nature to survive termination will continue to apply after termination.
14. Disclaimer of Warranties
To the fullest extent permitted by law, Wittle is provided "AS IS" and "AS AVAILABLE," without warranties of any kind, whether express, implied, or statutory.
O Street does not warrant that the App will be uninterrupted, error-free, secure, or free from defects, or that it will meet your particular requirements.
Nothing in this Agreement limits any non-waivable consumer rights that may apply under applicable law.
15. Limitation of Liability
To the fullest extent permitted by applicable law, O Street and its affiliates, licensors, and service providers shall not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, including loss of profits, data, goodwill, or business interruption arising from or relating to your use of Wittle.
Where liability cannot be excluded by law, our liability shall be limited to the maximum extent permitted by applicable law.
16. Changes to this Agreement
We may update this Agreement from time to time.
When material changes are made, we will update the "Last Updated" date at the top of this Agreement and may provide additional notice where required by applicable law.
Your continued use of Wittle after the updated Agreement becomes effective constitutes acceptance of the revised Agreement.
17. Governing Law
This Agreement shall be governed by the laws of the State of Washington, United States, without regard to its conflict of laws principles, except where applicable law requires otherwise.
